After my most recent conversations regarding the future of the film franchise, as well as the future of Smallville, I've come to realize something. We're not focusing on the right problem.
To my own personal knowledge, WB has declined over a dozen script ideas from some of the best comic writers out there. Again, that's just the ones I know about. There could easily be dozens more that I'm not aware of. So what is the problem? Why is WB declining all these ideas? You can bet your ass it's not because they aren't any good. Not when writers from DC who have created Superman stories as a career are being shot down. There must be a reason though.
I have 3 theories, of which none end well.
Theory #1
WB is holding off until the courts decide the percentage that must be shared with the Siegel family from properties produced between 1999 and 2008. As of now, the Siegels own 50% of the domestic rights to Superman and all elements from Action Comics #1 through #6. Beyond those issues, DC maintains full rights. However, it has yet to be established what percentage of profits made on current issues (beyond 1999) is owed due to the use of Superman in them. This sum of cash could be so big that WB doesn't see the point in making another film with the risk of having another Superman Returns on their hands.
Theory #2
WB has decided not to risk anything with the impending loss of the remaining 50% of Superman rights in October 2013 and is sitting back waiting for the opportunity to cash in instead. By this I mean that once they have lost all rights to the character, they will still own full rights to Lex Luthor, the Daily Planet, and all the biggest villains in Superman's history. In order for someone else to make a film the fans will accept, they'll have to pay WB/DC a huge chunk of change. No risk and all profit makes more sense from a business standpoint.
Theory #3
The Siegel family is holding up another film by exercising their 50% stake in the character for reasons that could include their lawyer wanting to produce rather than allowing WB to do so. Both the Siegel and Shuster heirs have stated they don't feel the character has been respected as he was created. Their reasoning for terminating the rights agreement was not solely about money, but about respect.
Whatever the reason, Superman is suffering greatly. Not just because of Bryan Singer or Brandon Routh, but because of corporate politics and greed. The question is, can we overcome this? Can the fans set aside differences long enough to band together and actually help save Superman? I believe we can.

Steve, OK, IF the Siegels & Shusters actually DO care how the character is presented, is there ANY WAY that we, the FANS, can negotiate with them personally? Whether it be snail mail, e-mail, or even phone calls, is there any way that you can get us in touch with THEM, so that WE, the FANS, can express how WE feel about this travesty of justice?
Alright, I know that duh apologists will automatically take the creators' sides as they were 'screwed' out of what they rightfully deserved & all of that, even though it was an HONEST BUSINESS DECISION back in the day?!
One point that I'D like to make to them is this. Are they gonna allow the DESTRUCTION of not only a favotite comics character, but also an American ICON?! All because of their war with WB/DC?! Can't you just IMAGINE the news networks as the COURTS decide Superman's fate? The DEATH of Superman indeed?! I can imagine it being a hot news item in the near future!
Steve, to emphasize again, HOW can we fans express ourselves to TPTB, INCLUDING the Siegels & Shusters? To let them know that WE have a voice in this thing also. After all, we are providing THEM with a regular paycheck, right? SO my request is that our voice be heard too!
Steve can be as high-minded about #3 as he likes but from where I sit this whole Siegel/Shuster business is nothing but a money-grab, pure and simple. DC has "finally settled" with Siegel and Shuster numerous times over the decades, and yet somehow some idiot fucking judge wanted to reverse all that. The reality is that Siegel and Shuster made a bad deal and never really made peace with it. Was it fair? Probably not, but that's life. Cry me a river, build a bridge and get the fuck over it.
ReplyDeleteNow the Siegel/Shuster heirs are chomping at the bit because they want a ride on the gravy train and an imbecelic judge is going to make it happen. If this was *EVER* about the integrity of the character, that went out the window years ago.
As always, it's about money and nothing else.
And ya know what? I don't have a problem with that. I just wish the Siegel/Shuster camps would stop the bullshit as though it's about some higher ideal.
I am with Colors on this one...The families are in it for the money. Shuster and Siegel screwed themselves and was indeed settled.

The family deserve nothing. They had nothing to do with creating the character.

This guy has beaten down WB on more than one occasion and won against other studios as well. His ability to win copyright suits lead to his founding of the production company Intellectual Properties Worldwide.
Yeah, but what does Toberoff think HE can give the Superman franchise that creative people already affiliated with the franchise can't? Does he think, on behalf of the Siegels, that he can give us a TRUE Superman film, or is this just a 'money grab' as Colors put it?
ReplyDeleteAlso, how safe is it to even contact the Siegels with one's own feelings? I mean, he IS a lawyer. Would we, the FANS, be subject to a lawsuit ourselves if we, in writing, were to tell the Siegels how we REALLY feel about this mess, by giving them a piece of our mind?
